Please read these terms “terms” and conditions carefully.

All courses have been produced by Two Glam Girls, Llc (“company”) and hosted and facilitated by Monique Melton (“host”). By registering, accessing, or purchasing our courses, you agree to enter into a legally binding contract with Two Glam Girls, Llc. If you do not agree to these terms, do not register, access, purchase, or otherwise use our course services.

Course participation, fees, and expenses

All fees and payments must be paid in full before confirming course registration. All fees are non-refundable and non-transferable. Purchasing one course allows one person to access the course. Access to the course is revocable by the course owner, and Two Glam Girls, LLC reserves the right to limit the length of time the participant has access to the course.

"To receive communications concerning the course and course content, users must opt-in to email communications from Two Glam Girls, Llc, dba Monique Melton. If the user fails to opt in, the user will not receive electronic communications related to the course or site content. The user will not be refunded for failure to accept electronic communication regarding the course."

We reserve the right to modify, remove, cancel, and limit any course without notice or refund. We also reserve the right to refuse participation by any person or group for any reason. All courses, with the exception of the shine box (™), are audio-only digital recordings from previously conducted, recorded live-group online classes. There are no visual aides, and the courses are audio-only.

Two Glam Girls, Llc is not responsible for any non-refundable expenses incurred by you or another as a result of your registration, attendance, non-attendance, or cancellation of any course. Two Glam Girls, Llc reserves the right to make changes to the courses at any time without notice.

Class conduct: It is unacceptable to solicit or contact class participants outside of class for any reason unless explicitly expressed by Monique Melton.

Class engagement: activity may be monitored, recorded, and shared with 3rd parties, including an employer of class participant.

As an enrolled student of the Shine Bright School, you will receive notifications via the email you provided at enrollment pertaining to classes you're enrolled in and related courses, which include notifications of Q&A sessions, additional parts to classes, updates to classes, and more. In order to provide our students with the best learning experience, this level of communication is required.

Access, Not Ownership:

Please note that your access to classes and courses on the Shine Bright School Dashboard does not constitute ownership of the content. Instead, it grants you limited, on-demand access to the specified courses, including, but not limited to, Unity Over Comfort, Shine Box, Shine Classes, the Parenting Course, the anti-diet Course, and other live and/or self-paced courses.

Limited Access Duration:

Access to on-demand classes and courses on the Shine Bright School Dashboard is granted for a period of up to 8 months as long as your payment remains current. After this period, your access may be terminated without notice.

Access to the paid membership community is available for as long as your payment is current. Access is terminated unless you renew your subscription or make necessary payments to extend your access.

Membership Benefits:

Paid membership on the Shine Bright School Dashboard includes access to the membership community and its associated benefits for as long as your membership remains active with complete payment. This ensures that you can fully participate in the membership features and enjoy the advantages of being a member.

Terms and Conditions Violations:

Access to classes, courses, and membership benefits may be limited or revoked without notice in cases of violations of our terms and conditions. These violations include unauthorized sharing of content, disruptive or harmful behavior within the community, or any other actions that breach our established guidelines.

Cancellation or Non-Payment:

Your access to the Shine Bright School Dashboard will be canceled immediately upon canceling or non-paying your membership. We reserve the right to suspend or terminate your access to our services if you fail to fulfill the necessary payment obligations.

To initiate the cancellation of your Shine Brighter Together subscription, please follow the outlined steps in the "How to Cancel" section of our FAQ. We encourage you to explore our supportive community as an alternative to cancellation.

For those seeking assistance in the cancellation process, our team at admin@moniquemelton.com is ready to help. Due to our small team size, cancellation requests will be addressed within 14-21 business days, excluding holidays and special observances. To ensure a smooth process, we recommend following the cancellation steps above to avoid any delays.

Refund Policy  

All sales are final, non-refundable, and non-transferable. No sales will be refunded regardless of the reason. If you have questions regarding any product, please email us at admin@moniquemelton.com. Please allow 2-4 business days for a reply, with the exception of holidays and vacation.

No refunds will be issued for cancellation requests received before or after payment processing. Please avoid canceling close to your renewal date to prevent any disruptions to your subscription.

Copyright 

All content included or made available through online or in-person courses, including all text, images, graphics, audio commentary, visual presentations, and any course-related files, are the property of Two Glam Girls, LLC or its content providers and are protected by United States and international copyright law. Materials cannot be copied, reproduced, distributed, or published in any form without prior written approval by Two Glam Girls, LLC. All material provided and presented during training is for the sole use of the company and/or individual and may not be shared or disseminated to third parties.  

Miscellaneous  

Recording, including audio, video, and screen capture is not permitted during training. No warranties or guarantees are made in any of the materials. By using any material provided you accept all liability for your actions. Two Glam Girls, LLC reserves the right to prohibit access to online material to any person or eject any person from the seminar and/or course participation based on behavior deemed inappropriate by Two Glam Girls, LLC, Monique Melton staff, and/or their agents and others working under their authority. Delegates agree to be contacted via email, SMS or other means for the purpose of sharing information and updates related to the relevant training event. The organizers will not be responsible for any loss, damage, or injury occurring during the event. Monique Melton may vary these terms and conditions at any time. Any variations become effective on posting.

Promotions and Offers

We reserve the right to modify, cancel, and limit any promotion or offer. We reserve the right to refuse to provide offers and/or promotions to any particular individual, group, or organization at our discretion. No warranties or guarantees are made. By using any techniques or resources provided, you accept all liability for your actions.

Nature of content shared 

The customer understands that the information shared may be potentially triggering, and deeply emotional and that some personal information about the host, Monique Melton, may be shared. Customers may be asked to share personal information. At all times customer has the right to decide on the degree of their participation when asked to consider their mindset, personal beliefs, emotions, educational background, experiences, actions, and attitudes that result in insights that may be outside of the customer’s comfort zone.  

 Liability

Two Glam Girls, LLC is not responsible or liable for the outcome or results of any service provided to the customer. Two Glam Girls, LLC is not responsible for the company’s content, service, product reliability, credibility, validity, or sustainability. Two Glam Girls, LLC maintains no liability or responsibility for the customer, including the business, personal, service, or products provided by any customer for any reason, without exception. The customer maintains all liability and responsibility for their business & personal matters at all times. Two Glam Girls, LLC does not offer any type of professional legal, medical, psychological, or financial advice, and your participation will not treat, diagnose, or cure any disease. The customer accepts full responsibility for the outcomes of any and all services provided by and or affiliated with Two Glam Girls, LLC. Individual results will vary. Participation in any courses or seminars is at your own discretion.

While we strive to provide a seamless and uninterrupted learning experience, we cannot guarantee the continuous availability of our services. We shall not be held liable for any loss, damages, or inconvenience arising from the temporary or permanent unavailability of the Shine Bright School Dashboard or its associated services.

We recommend that you review our terms and conditions in detail to ensure full compliance and understanding of your rights and obligations as a user of the Shine Bright School Dashboard.

By accessing our website and using our services, you acknowledge and agree to be bound by the terms and conditions mentioned in this disclaimer.

Confidentiality   

Customer agrees to the following:

1. The customer will uphold strict confidentiality regarding all matters (names, events, etc.) Pertaining to the work or identity of other customers in the group.

2. The customer will not disclose information shared within this experience and/or about another group member outside of the group verbally or through any written or electronic means, including email, social media, such as Facebook, Twitter, and any other public forums.

3. All information shared during the group is confidential.

4. If a customer shares information, the customer is subject to being removed from the group without warning and without receiving a refund for the services. The customer may be held civilly liable to Two Glam Girls, LLC, or any injured party for the release of confidential information.

5. This is to ensure a safe and private learning experience. 

The customer also agrees to hold Two Glam Girls, LLC harmless from any violations of this confidentiality clause. You agree that Two Glam Girls, LLC shall not be liable for the actions of any other participants or third parties that may be considered violations of this confidentiality agreement.

Disclaimer

Two Glam Girls, LLC makes no guarantees or claims for any services or opinions provided to the customer for any reason. The customer agrees to accept full liability and responsibility for any outcome, result, or impact of any service. Neither Two Glam Girls, LLC nor our staff, partners, or any of their affiliates, will be held liable for any direct, indirect, consequential, special, exemplary, or other damages that may result, including but not limited to economic loss, injury, illness, or death. If the customer or any other person accessing the information in this experience has any concerns or conditions he or she should regularly consult with the appropriate licensed professional, medical doctor, therapist, or health care professional for treatment, care, and/or diagnosis. All results may vary.  

Third party content:  

The courses and materials may contain links and materials from other third parties. Two Glam Girls, LLC may mention or reference information from third parties or their websites, however, we have no control over and do not assume any responsibility for the content, privacy policies, or practices of any third-party websites or services and we do not imply endorsement, sponsorship or recommendation thereof, or any affiliation with our company or staff. We are not responsible for any form of examination or evaluation of the third-party content including the accuracy thereof. Two Glam Girls, LLC does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. The customer agrees to hold Two Glam Girls, LLC harmless from any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Any grievances, complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.   

DMCA notice and procedure for copyright infringement claims

We will respond quickly to claims of copyright infringement according to the terms of the Digital Millennium Copyright Act of 1998 (DMCA) as found under United States law (17 USC. § 512). If you believe any copyrights are infringed by our courses, please provide us with a written notice via email to admin@moniquemelton.com that contains the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

2. A description of the copyrighted work that you claim has been infringed;

3. A description of where the material that you claim is infringing is located on our website;;

4. Your address, telephone number, and email address;

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

6.  A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

We are only required to respond to those notices that substantially comply with the above requirements.  We will investigate your claim and will notify you by the method of contact you used to file your notice with us. 

Video/Photograph/Audio/Text Waiver

The customer hereby grants Two Glam Girls, LLC (the “host”) the irrevocable right and permission to use photographs and/or video/audio recordings of me on the company, host, or other websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to the customer.

The customer understands and agrees that such photographs, video, audio recordings and/or comments/written text of me may be placed on the internet. The customer also understands and agrees that he/she may be identified by name and/or title in printed, internet, or broadcast information that might accompany the photographs and/or video recordings of me. The customer waives the right to approve the final product and agrees that all such comments/written text, portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape, and digital files are and shall remain the sole property of the company.

Customer hereby releases, acquits, and forever discharges Two Glam Girls, LLC, the host, its current and former trustees, agents, officers, and employees of the above-named entities from any and all claims, demands, rights, promises, damages, and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

The customer warrants that he/she is eighteen (18) years old or older and competent to contract in his/her own name, or, if less than eighteen years old, that a parent or guardian has signed the waiver of liability and release form provided by the company in connection with participation in the courses. The customer agrees that the release is binding on him/her and my heirs, assigns, and personal representatives.    

Rescheduling by Company or Host

The customer agrees that in the event of a circumstance, such as acts of god, inclement weather, terrorist activity, high levels of traffic or traffic accidents, and/or medical/familial emergency, which restricts Two Glam Girls, LLC the ability to provide any or all the services included in the customer’s contract or scheduled project plan, with or without advance notice, Two Glam Girls, LLC will reschedule project service date within reason, if applicable. Within reason is at the sole discretion of Two Glam Girls, LLC. The determination of restriction of Two Glam Girls, LLC’s ability is at the sole discretion of Two Glam Girls, LLC. The customer agrees that a reasonable attempt to reschedule service dates or delivery of services is the only liability to Two Glam Girls, LLC and any and all of its owners, employees, and agents, and the customer agrees to release the same of any claims. By engaging in this experience, you acknowledge and agree to your voice being recorded for educational, training and quality assurance purposes. By participating in this experience, you agree to have your voice, name, and recording to be used by Two Glam Girls, LLC at their sole discretion. You release all rights to the recording and will not be provided with any monetary compensation for said recording. Two Glam Girls, LLC reserves the right to use said recording for any length of time without your written or expressed permission. You acknowledge and agree to the irrevocable use of the recording from the class experience. By participating in this experience, you acknowledge that you have read and agree to the complete terms and conditions. Dates and details regarding classes may change without notice.

Limitations and exclusions of liability

The limitations and exclusions of liability set out in this section and elsewhere in this disclaimer and the terms govern all liabilities arising under the disclaimer or in relation to these digital products, including liabilities arising in contract, in tort (including negligence), and for breach of statutory duty. We will not be liable to you for any losses arising out of using the information contained in these digital products.

Two Glam Girls, LLC will not be liable to you in respect of any professional losses, including without limitation loss of or damage to reputation, job security, or loss of opportunity. We will not be liable to you in respect of any loss or corruption of any data, database or software. We will not be liable to you in respect of any special, indirect or consequential loss or damage.

Exceptions 

Nothing in this disclaimer shall limit or exclude our liability for fraud or fraudulent misrepresentation, limit any of our liabilities in any way that is not permitted under applicable law; or exclude any of our liabilities that may not be excluded under applicable law.

Severability 

If a section of this disclaimer is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of this disclaimer continue in effect. If any unlawful and/or unenforceable section would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the section will continue in effect.

Law and jurisdiction 

This disclaimer will be governed by and construed in accordance with the state of Maryland, and any disputes relating to this disclaimer will be subject to the exclusive jurisdiction of the courts.

Contributors 

Contributing and/or submitting content for a survey or a request for feedback in the form of electronic, print, and/or verbal, digital audio/visual recording, or through any other method is completely optional. It is to be conducted at the contributor’s own risk without any form of compensation or particular acknowledgment, unless otherwise explicitly specified in a written contractual agreement signed by all members involved.

By submitting any form of information in the form of electronic, print, and/or verbal or through any other method to the company or host, the customer consents to the company and host complete usage of said content, unless a confidential agreement is on file for the information disclosed in the survey or during a conversation regarding feedback/input about services and or your experience with Two Glam Girls, LLC. The company maintains the complete and ongoing, completely royalty-free license to use for any submitted content or information at the host or company’s sole discretion for any purpose the host deems necessary. Company and host have the complete discretion to edit, without changing the nature of the content any information submitted or contributed for any reason and uphold the right to modify, publish, distribute, reproduce, and maintain all copyright and publicity rights of any information submitted or contributed with respect to that information at company or host’s sole discretion, without providing notice or consent. The company may archive and store on the company’s website and corresponding publication channels and may include the full or partial content in any other publications or creations in any form of media available now and or in the future.

Two Glam Girls, LLC, and the host maintain the sole discretion to edit, modify, deny, or delete any content at any time without notice. If you do not wish to agree to any of the rights mentioned, please do not submit any content or information to the host through any form of media.

Nature of this experience

Customers understand that material shared and discussed in the lectures (course material) is potentially triggering, and deeply emotional and that some personal information about the host and/or other participants may be shared. Customers may be asked to share personal information, if applicable. At all times customer has the right to decide on the degree of their participation and to ask for further explanation or support. A course learning material may include teaching, group coaching, and group participation as appropriate. In the group and/or course environment, customers may be asked to consider their mindset, personal beliefs, emotions, educational background, experiences, actions, and attitudes resulting in insights that may be outside of the customer's comfort zone. Participation is optional and should be considered at your own risk.

Publication Right 

By signing this agreement, the customer acknowledges that Two Glam Girls, Llc and host Monique Melton reserve the right to use samples of any/all work created for the customer in the company’s Shine Bright School portfolio. The customer also acknowledges that the company reserves the right to use the customer’s name on the company or host’s website as a “past/current customer.”  

Limit of liability 

Maximum damages. The customer agrees that the maximum amount of damages the customer is entitled to in any claim of or relating to this agreement or services provided herein does not exceed the course total fee.    

Indemnification

Customer agrees to indemnify, defend, and hold harmless Two Glam Girls, LLC and host Monique Melton their its employees, agents, and independent contractors for any economic injury, damage, liability, claim, or other cause of action arising out of or related to services and/or products company and host provide to customer through the Shine Bright School.  

Compatibility 

Monique Melton reserves the right to determine compatibility for the customer if working together is in the best interest of the customer and Monique Melton (shine bright school). Monique Melton reserves the right to remove any customer at any time without notice, especially, but not limited to, in the case the customer does not corporate or follow the rules and boundaries outlined for course participation.  

No Representations or Warranties 

The information provided in these digital products is for general informational and educational purposes only. Neither the company nor the host assumes and hereby disclaims any liability to any party for any loss, damage, or disruption caused by errors or omissions, whether such errors or omissions result from negligence, accident, or any other cause. There are no representations or warranties, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the information, products, services, or related graphics contained in these digital products for any purpose. Any use of this information is at your own risk.

The methods used in these digital products are the host’s personal thoughts. They are not intended to be a definitive set of instructions. Digital Downloads  and Single Use Policy

Any downloaded content is for single use only. Downloads may not be shared or dispersed, reproduced, or distributed to anyone other than to the email user that purchased the download for group or corporate access to files please inquire at admin@moniquemelton.com

Chargeback Abuse Policy

The customer agrees not to file a debit card or credit card chargeback Paypal dispute or dispute or any other type of chargeback dispute with any financial institution related to any purchase. In the event of a breach of this agreement, if a resolution is in the host's favor customer agrees to reimburse the host for any costs incurred while responding to and researching such chargeback. This includes, without limitation, Two Glam Girls, LLC's actual costs paid to the credit card processor or relevant banks, other appropriate third parties, and the reasonable value of time spent by the host on the matter. These determinations will be made by the host at the host's discretion, with good faith. The customer also agrees that these costs will be added to the original amount of the order. The updated total amount will be immediately due and payable. - if the customer’s chargeback is upheld, the customer agrees to pay all the same costs, in addition to the original purchase price.

Privacy Policy

This privacy policy governs the manner in which the moniquemelton.com and shinebrightschool.com websites, and the owner of Two Glam Girls, LLC, (a forward referred to as “website”) collects, uses, maintains, and discloses information collected from users (each, a “customers”) of the website and affiliated services and products. This privacy policy applies to the website and all classes, courses, and services offered on the website. 

Personal Identification Information   

We may collect personal identification information from customers in a variety of ways, including, but not limited to, when the customer enrolls in the school or a course within the website or third-party links provided by the owner, subscribes to a newsletter, and connection with other activities, services, features, or resources we make available in our website and services. Customers may visit the website anonymously. We will collect personal identification information from customers only if they voluntarily submit such information to us. Customers can refuse to supply personal identification information but doing so may prevent them from engaging in certain website, course, and class-related activities.

The website may collect and use customers’ personal identification information for the following purposes: to improve customer service. 

• Information you provide helps us respond to your customer service requests and support needs more efficiently. To personalize user experience

• We may use customer email addresses to send customer information and updates pertaining to their order. Customer email addresses may also be used to respond to customer inquiries, questions, or other requests.

By purchasing and/or participating in the website and affiliated products and services, you signify your acceptance of this privacy policy. If you do not agree to this privacy policy, please do not purchase or participate in the website or affiliated products or services.
